VERIZON WIRELESS MARINERS ULTIMATE FAN EXPERIENCE SWEEPSTAKES
OFFICIAL RULES (the "Official Rules")
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
Eligibility: Open to legal U.S. residents who reside in the states of Washington, Oregon and Idaho, and are eighteen (18) years of age or older as of date of entry. Employees and their immediate family members (parents, siblings, children and spouse, and persons residing in the same household whether related or not) of Seattle Mariners and Verizon Wireless (collectively referred to herein as "Co-Sponsors"), the MLB Entities and each of their respective parent and affiliated companies, subsidiaries, and advertising and promotion agencies, and all other companies associated with the Sweepstakes, and their respective agents, officers, and directors, and all individuals, including, but not limited to, consultants, independent contractors, so-called "temporary employees," former employees and interns (and their immediate family members), who have, within the past six months, performed services for Co-Sponsors, are not eligible to enter or win. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM" or "MLB.com"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities.
Sweepstakes Period: Sweepstakes begins on September 16, 2009 at 12:01 a.m. Pacific Standard Time ("PST") and ends on September 27, 2009 at 11:59:59 P.M. PST. (the "Sweepstakes Period").
Entry: To enter the Sweepstakes entrants must enter by one of the following methods:
All entries by text messaging become the sole property of Verizon Wireless, and receipt of such entries will not be acknowledged or returned. Incomplete entries are void. Only one (1) entry per person, regardless of method of entry.
Random Drawing: A total of one (1) winner will be selected from all eligible entries in a random drawing to be held on or about September 28, 2009 from among all eligible entries received. Winner will be notified within two (2) days of drawing date and must respond to such notice within two (2) days of issuance or a disqualification will result, the prize will be forfeited and, at Co-Sponsors' sole discretion and time permitting, an alternate winner may be selected from among all remaining eligible entries.
Prizes: One (1) Grand Prize will be awarded from the Sweepstakes as follows: One (1) Grand Prize winner will receive two (2) terrace club level tickets to the October 4, 2009 Seattle Mariners v. Texas Rangers game to be played at Safeco Field in Seattle, WA at 1:10 pm PST (the "Game"); an on-field photograph with a player (such player to be determined by the Mariners in their sole and absolute discretion), fan recognition on the Safeco Field matrix board at the Game; and two (2) Mariners fan packs that will include a hat, sweatshirt, pennant, and one (1) baseball autographed by one (1) or more player(s) to be determined by the Mariners in their sole and absolute discretion. TRANSPORTATION TO AND FROM THE GAME IS NOT INCLUDED. Approximate Retail Value ("ARV") of grand prize is: $430. All aspects of the Grand Prize not specified herein shall be determined by Co-Sponsors in their sole and absolute discretion.
All federal, state, and local taxes and fees, including income tax and sales tax , and any other expenses arising out of the receipt and use of the prizes, including but not limited to lodging, transportation costs, meals, gratuities and other expenses incurred by accepting the Grand Prize are solely the responsibility of the winner. Any difference between the stated estimated value of a prize and its actual value will not be awarded. By acceptance of the Grand Prize, Winner agrees to accept prizes "as is." Sweepstakes Entities (defined below) (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty.
Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Winner(s) and his/her guest(s) agree to comply with all applicable ballpark regulations in connection with the Prize. Co-Sponsors and the applicable MLB Entities reserve the right to remove or to deny entry to Winner(s) and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Sweepstakes Entities will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition.
Odds of Winning: Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.
Restrictions: Prizes are not replaceable if lost, damaged or stolen. Prizes are nonrefundable and nontransferable. Sweepstakes Entities are not required to offer any substitutions, cash redemptions, or alternative to prizes awarded under this Sweepstakes. Co-Sponsors reserve the right to substitute a prize (or portion thereof) with one of equal or greater value in the event a prize is unavailable. Recipients of prizes must have a U.S. mailing address. All prizes awarded are subject to the restrictions and limitations noted in these Official Rules, on the prizes and/or included with the prizes.
General Entry Rules: Any individual who attempts or otherwise encourages, directly or indirectly, false contact information under multiple identities, by cellular phone, Internet, or otherwise, or uses any device or artifice to enter or encourage, directly or indirectly, multiple or false entries, as determined by the Co-Sponsors and/or MLBAM, as applicable, will be disqualified. The use of automated entry devices or any other conduct that impedes the integrity of the Sweepstakes is prohibited. Mutilated, lost, illegible, or incomplete entries will be deemed ineligible and disqualified. In the event of a dispute as to the identity or eligibility of any winner based on a telephone number or an e-mail address, entry information will be declared made by the authorized account holder of the telephone number and/or email address, as applicable, submitted at the time of entry provided he/she is eligible according to these Official Rules. "Authorized account holder" is defined as the natural person who is assigned to a telephone number/email address by a telephone company, wireless service provider, Internet access provider, Internet service provider or other organization (e.g. business, educational, institution, etc.) that is responsible for assigning email addresses, telephone numbers or wireless phone numbers for the telephone exchange associated with the submitted telephone number/email address or the domain associated with the submitted telephone, as applicable.
Co-Sponsors, , the MLB Entities and each of their respective parents, subsidiaries and affiliates, advertising and promotion agencies, suppliers (including all prize providers), printers, and distributors, and the respective officers, directors, employees, representatives and agents of each and any other person or entity related in any way to this Sweepstakes (collectively "Sweepstakes Entities"), are not responsible for late, lost, incomplete, misdirected, or damaged entries or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to play or participate, or by any human error that may occur in the processing of the entries in this Sweepstakes, or for any printing errors in these Official Rules. If for any reason (including infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other cause corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes (or any portion thereof)) the Sweepstakes (or any portion thereof) is not capable of being conducted as described in these Official Rules, Co-Sponsors and MLBAM, as applicable, shall have the right, at their sole and absolute discretion, to cancel, terminate, modify or suspend this Sweepstakes (or any portion thereof), and select the prize winners by way of random drawing from among all non-suspect, eligible entries received up to the time such action is taken. Co-Sponsors and MLBAM reserve the right to prosecute any fraudulent entries to the fullest extent of the law. At Co-Sponsors' sole discretion, entrants, winners and guests who do not comply with these Official Rules or attempt to interfere with this Sweepstakes in any way may be disqualified.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CO-SPONSORS AND MLBAM WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
Release and Indemnification: By entering, each entrant agrees to be bound by these Official Rules and the decisions of Co-Sponsors which shall be final for all purposes hereunder, and agree: (1) if selected as a winner, Co-Sponsors, MLBAM, and each of their respective designees may use his/her name, likenesses, image, photograph, voice, address (city and state of residence), statements, biographical information and prize information for advertising, trade and promotion in any and all media or format now known or hereafter devised, including on the Internet or via wireless application protocol, throughout the world, in perpetuity, without further compensation or consideration, permission or notification, except where prohibited by law; and (2) to release, hold harmless and indemnify each of the Sweepstakes Entities from and against any and all liability, damages, losses, injuries or causes of action (however named or described) with respect to or arising, directly or indirectly, in whole or in part, out of either (i) entrant's participation in the Sweepstakes or in any Sweepstakes-related travel or activity; and/or (ii) the receipt, possession, or use or misuse of any prize awarded in the promotion, including but not limited to any claims for damage to property, personal injury or death, or claims based on defamation, rights of privacy, rights of publicity or merchandise delivery. Winner will be required to complete, sign and return an Affidavit of Eligibility and Liability Release or prize may be forfeited and awarded to an alternate.
Miscellaneous Conditions: Except to the extent pre-empted by federal or other applicable state law, the Sweepstakes shall be governed by the laws of the State of New Jersey, without giving effect to any conflict of law provisions thereof. By participating in the Sweepstakes, each entrant agrees that any and all disputes which cannot be resolved between entrant and Co-Sponsors, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the County of Somerset, State of New Jersey, having competent jurisdiction, which court shall apply the laws of the State of New Jersey without giving effect to any conflict of law provisions thereof. Any personal information supplied by any entrant via text messaging entry method will be subject to Verizon Wireless' privacy policies posted at http://www.verizonwireless.com.
